Hoover senior fellow Richard Epstein rejects the suggestion from the Electronic Frontier Foundation (EFF) that legislation be enacted to stop state-funded universities from transferring university-owned patents to patent assertion entities (PAEs). He reasoning is that (1) PAEs serve as intermediaries, (2) universities have no special expertise in commercializing patents, and (3) patentees must protect their intellectual property, often through litigation.
