David Davenport, counselor to the director and a research fellow at the Hoover Institution, notes that the two to one decision overturning proposition 8, by the Ninth Circuit Federal Court, raises many questions, such as, Should two federal judges substitute their judgment for the people’s vote? Should states or the federal government decide social questions? Will other states have to recognize California's same-sex marriages? The case will be appealed to the Supreme Court, which will make the final decision.
