A Republican Senate Can Help Send U.S. Weapons to Ukraine

by Paul R. Gregoryvia Forbes
Friday, October 10, 2014

The Mid-Term Elections can become a mini-referendum on the Obama administration’s inaction towards Ukraine. With a continued Democratic senate majority, Harry Reid will block the pro-Ukraine bills working their way through Congress. Ukraine has a chance of getting weapons to fend off Russian aggression only with Republican control of the Senate.

History Suggests That Congress Will Only Authorize Force Against the Islamic State If the President Proposes and Pushes For an Authorization (or Screws Up Unilateral Force Badly)

by Jack Goldsmithvia Lawfare
Tuesday, October 7, 2014

President Obama says he would “welcome congressional support” but does not need authorization from Congress in order to use force against the Islamic State.  The President appears to have taken no steps to propose actual language to Congress or to move the idea of an authorization along.

Congress and War On ISIS: "Just Bomb the Place and Tell Us About It Later"

by David Davenportvia Forbes
Monday, September 22, 2014

To be fair, the constitutional questions surrounding U.S. military action against ISIS are not easy.  But those wanting Congress to play a larger role in declaring wars, and not simply defer to the Commander in Chief, have a right to be disappointed when Congress, in effect, gave itself a pass and left town early to go home and campaign.

Further Reflections on the Legal Rationale For Using Force Against the Islamic State

by Jack Goldsmithvia Lawfare
Friday, September 12, 2014

I had a pretty harsh reaction to the administration’s claim that Congress in the 2001 AUMF authorized force against ISIS in Iraq and Syria.  (For a different view, see Marty Lederman’s post.)  While I think the administration’s interpretation of the 2001 AUMF is unconvincing, I do not believe (as Bruce Ackerman appears to say today in the NYT) that military action against the Islamic State — to date or in the future — is unlawful under the Constitution.

Not Asking the Girl to Dance

by Benjamin Wittesvia Lawfare
Wednesday, September 10, 2014

Here’s President Obama coyly not asking Congress to dance—that is, as I put it in my post earlier today, “signal[ing] that [he] would like to dance with Congress—saying [he] will consult with her, that [he] invites her support—but [stopping] short of anything like a formal request, and he insist[ing] that he’s happy to dance alone.”
